By reserving a charter or using our Service, you consent to these Terms. If you do not agree with any section of these terms, you must not utilize the Service.
2. Service Overview
SharedUtilityCatalog offers elite yacht charter services, which include, among other things:
- Yacht rentals for daily use
- Evening cruises
- Company retreats
- Exclusive events
- Extended charters
We can change or cease services at our discretion, and all services are subject to availability and suitable weather.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you must:
- Be over the age of 18
- Provide valid and complete details
- Make the necessary down payment as delineated in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A confirmed booking is only achieved once your payment is received and we send a written confirmation. We have the authority to decline service at our discretion.
3.3 Availability
Our charters are subject to the accessibility of vessels and favorable weather. We'll strive to accommodate your requested dates and timings where possible.
4. Payment Terms
4.1 Pricing
Prices are quoted in € and include relevant taxes except when noted otherwise. Prices can vary without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter, payable at the time of booking
- Final payment: Required 48 hours prior to the charter's departure
- Additional charges (where applicable): Due after the charter concludes
4.3 Payment Methods
We accept leading credit cards, wire transfers, and certified bank checks. Payments are processed via secure, encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancellations are made over 72 hours before departure: Entire refund less transaction fees
- If cancellations are made between 24 to 72 hours before departure: 50% refund
- If cancellations are made less than 24 hours before departure: No refund will be provided
5.2 Weather Cancellations
In case the weather is unsafe as determined by our captain, we will suggest to:
- Reschedule your charter to another available date at no extra charge
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
Should your vessel encounter mechanical problems, we will try to offer a suitable alternate. If we cannot provide an alternative, we will give you a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Obey all instructions from the crew
- Utilize provided safety gear when needed
- Inform us of any health conditions impacting their safety
- Stay within designated vessel zones
6.2 Prohibited Items
Certain items are forbidden aboard:
- Glass items
- Illegal contraband
- Guns or other weapons
- Excessive amounts of drinks (beyond moderate consumption)
- Animals (except with previous authorization)
6.3 Conduct
Guests are expected to behave respectfully. We reserve the authority to cut a charter short if a passenger's behavior represents a danger or spoils the experience for others, with no reimbursement given.
7. Liability and Insurance
7.1 Our Liability
Our liability is capped at the sum you have paid for the charter. We are not liable for:
- Injuries sustained from a guest's heedlessness
- Lost or marred personal belongings
- Indirect, incidental, or punitive losses
- Delays due to weather or events beyond our control
7.2 Insurance Coverage
We maintain a comprehensive marine insurance that covers both our vessels and operations. It is your responsibility to obtain your own travel and personal insurance.
7.3 Assumption of Risk
You acknowledge the inherent risks associated with maritime activities by partaking in our charters and you accept responsibility for your own security and welfare.
8. Modifications and Itinerary Changes
We may change itineraries, courses, or timetables when required by weather conditions, safety needs, or operational necessities. We will make an effort to offer equivalents if alternatives are necessary.
9. Force Majeure
Our obligations are dispensed when unexpected events occur beyond our control, this includes but is not limited to:
- Extreme weather
- Natural calamities
- Regulatory actions
- Port interruptions
- Vessel dysfunctions
10. Privacy and Data Protection
We handle your private data according to our Privacy Policy. By using our Service, you consent to the collection and application of your data as laid out in the Privacy Policy.
11. Intellectual Property
All content seen on our website is protected by copyright and trademark laws, covering text, images, and graphics. Reproduction, distribution, or the creation of derivative work without our express authorization is prohibited.
